1. Mediation is set up like a meeting style informal process with structure where a neutral third party—known as the mediator—helps couples negotiate and resolve issues related to their divorce. These issues include all aspects of divorce like dividing assets, deciding on child custody and visitation, spousal support, and more.

The mediator’s role isn’t to make decisions for the couple, like a judge would, but rather to guide them toward mutually agreeable solutions. Think of the mediator as a facilitator who helps manage the conversation, clarify misunderstandings, and offer different perspectives.

3. The Mediation Process: What to Expect The mediation process typically begins with both spouses agreeing to work with a mediator. Each party may have a lawyer present or choose to consult with their lawyer outside of the mediation sessions.

Here’s what the typical process might look like:

• Initial Meeting: The mediator meets with both spouses to explain how mediation works and set some ground rules. This is a chance for everyone to express their goals and concerns.
• Identifying Issues: The mediator helps identify the key issues that need to be resolved—whether it’s property division, custody, alimony, or something else.
• Negotiation: The heart of mediation involves structured negotiation. The mediator guides the discussion, encouraging both parties to voice their needs and find compromise. This might take several sessions, but the goal is always to reach mutually acceptable solutions.
• Final Agreement: Once all the issues are resolved, the mediator helps draft a final agreement.
